Terms of Service

Last updated: 2 July 2026 · Operator: phpMyDEV, LLC ("Curio", "we", "us") · Contact: curio@whitneys.co

These Terms govern your use of Curio. By creating an account or installing the Curio

widget, you agree to them. If you don't agree, don't use the service.

1. The service

Curio is a hosted AI assistant you embed on your website. It answers your visitors'

questions using content you connect, over an operator-hosted AI model. Features and limits

may change as the product evolves.

2. Eligibility and your account

You must be able to form a binding contract and, if using Curio for an organisation, be

authorised to bind it. Keep your sign-in email secure; you're responsible for activity

under your account. One person's actions on a linked account bind the account.

3. Free trial, credits, and billing

day. After the trial, or once the day's free conversations are used, the assistant runs

on prepaid credits you purchase.

balance reaches zero and no free allowance remains, the assistant pauses until you

top up. We'll email you before it does where we can.

except where refunds are required by law.** Credits have no cash value.

credits already purchased.

4. Your content and responsibilities

You grant us a limited licence to process it solely to operate the service for you.

content you provide, and that they don't infringe others' rights.

its lawful use, for your visitors, and for meeting your own obligations to them

(including your own privacy notice -- see our Privacy Policy and

DPA).

5. Acceptable use

Don't use Curio to: break the law; infringe or misappropriate others' rights; upload

malware; probe, overload, or circumvent our security or rate limits; resell or expose the

service in a way that competes with it in bad faith; or deploy it toward any use

prohibited by the EU AI Act or other applicable law. We may suspend accounts that do.

6. AI output -- no guarantee of accuracy

Curio's answers are generated by an AI system from the content you connect. They can be

incomplete or wrong. **The assistant's output is provided for convenience and is not

professional advice.** You are responsible for reviewing how the assistant represents your

business, and you can correct or override any answer using the tools we provide. Don't rely

on it for decisions that require professional judgement.

7. Availability

We aim for high availability and publish our commitment in the SLA, including any

service credits. The service is otherwise provided on an "as available" basis.

8. Intellectual property

We own the Curio platform, software, and brand (including Hugo). You own your content.

Nothing here transfers ownership either way beyond the limited licences stated.

9. Third-party services

Curio relies on third-party providers listed on our Sub-processors page.

We're not responsible for their acts or outages beyond our reasonable control.

10. Disclaimers

To the maximum extent permitted by law, Curio is provided **"as is" and "as available,"

without warranties of any kind**, express or implied, including merchantability, fitness

for a particular purpose, non-infringement, and any warranty that the service or its

output will be uninterrupted, error-free, or accurate.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental,

special, consequential, or punitive damages, or for lost profits, revenue, data, or

goodwill. **Our total liability for any claim relating to the service is limited to the

amount you paid us for it in the three months before the claim arose** (or USD 100 if you

paid nothing).

12. Indemnification

You will defend and indemnify us against claims arising from your content, your use of the

service, or your breach of these Terms or applicable law.

13. Termination

You may stop using Curio and close your account at any time. We may suspend or terminate

access for breach of these Terms, non-payment, or where required by law. On termination,

your right to use the service ends; sections that by their nature should survive (e.g.

9-12) survive.

14. Changes

We may update these Terms; the "last updated" date will change and material updates will

be noted in our changelog. Continued use after a change means you accept it.

15. Governing law

These Terms are governed by the laws of the State of Arizona and applicable United States

federal law, without regard to conflict-of-laws rules. The state and federal courts located

in Arizona have exclusive jurisdiction, except that either party may seek injunctive relief

where available.
